Why this privacy statement?
We care about your privacy. This statement explains which personal data we collect, why we do this and what your rights are. Everly B.V. is responsible for this data. The legal term for this is "controller".
In short:
- We only collect what you give us yourself or what we need to run the website and the app.
- We never sell your data.
- We do not send newsletters. You only get from us what you asked for.
- You can always ask us to see or delete your data at contact@everly.one.
What do we collect, and why?
What we collect depends on what you do with us. Below we explain three situations: you fill in a form or email us, you visit our website, or you test the everly app.
We may only use your personal data if we have a good reason. The legal term for this is "legal basis". For each situation we say which one applies.
1. You fill in a form or email us
On our website you can leave your details, for example to hear when everly opens for you, to receive an overview from us or to talk to us.
What we collect
- your email address. This is required: without it we cannot reply to you;
- your name, organisation, role and type of organisation, if you fill them in;
- your answer to our question whether everly would suit you;
- whether you would like a conversation with us;
- what you write to us.
What for
- to reply to you;
- to send you what you asked for: the overview, or a message when everly opens for you;
- to plan a conversation, if you asked for one.
Legal basis. Consent. You decide yourself whether to fill in the form. You can withdraw your consent at any time by emailing contact@everly.one. We then delete your details. If you email us yourself, we use your details to reply because we have a legitimate interest in doing so: you asked us something.
How long. Until we have sent you what you asked for, and then at most 6 more months. If we stay in touch, the 6 months count from our last contact.
2. You visit our website
What we collect
- technical data, such as your IP address, browser type and the time of your visit. Every web server records this;
- on the website, without cookies: which pages you open, where you came from, how far you scroll and which buttons you click. Not what you type in a form;
- in the app and the Journal, only if you accept statistics cookies: which pages you view, and a recording of how you move around the pages and click. In that recording all text and everything you type is made unreadable. In the app we also send the type of situation you chose at the start.
What for
- to show you the website and keep it secure;
- to see which pages help visitors and where they get stuck, so we can improve the website and the app (statistics).
Legal basis. For the technical data, legitimate interest: without this data the website cannot run securely. For statistics on the website, also legitimate interest: we want to know which pages help visitors, and we do this without cookies and without recordings. You can object at any time: switch the statistics off on our cookie policy page, or write to us. For statistics in the app and the Journal, consent. You give it in the cookie banner and can withdraw it at any time.
How long. Technical data at most 30 days. Statistics at most 12 months, recordings at most 1 month.
Our website loads fonts from Google Fonts. In doing so, Google receives your IP address.
You can read more about cookies in our cookie policy.
3. You test the everly app
The everly app is currently in a closed test with a small group of testers. We ask testers not to enter real personal information, but to use made-up names, situations and details.
What the app can store
- account details: name, email address and password. Clerk handles the login for us;
- profile details, such as date of birth, gender, address, phone number and GP;
- your answers at the start: your situation, what you have already arranged, what worries you and how you feel;
- what you fill in in the different sections, such as money matters, documents, wishes for the farewell, personal messages, your life story and your diary;
- names and contact details of other people, such as trusted persons. We do not send them any messages;
- information about health and the end of life, such as a diagnosis, a euthanasia request, an advance directive or organ donation;
- whether you want a religious or non-religious funeral.
Everything you fill in is saved in your account in our database, including letters with voice recordings and wishes for the farewell. While you use the app, your browser also keeps a working copy so the app responds quickly. That copy is removed from the browser when you sign out.
Information about health and religion is special category personal data. The law gives it extra protection. That is why we ask testers to enter only made-up information here. Before the app opens for real use, we will ask for your explicit consent for this and update this privacy statement.
What for. To show you a plan based on what you fill in, and to test and improve the app.
Legal basis. Consent. You take part in the test yourself and can stop at any time.
How long. Until the end of the test. After that we delete all test data. Want to stop earlier? Email contact@everly.one and we will delete your account and your data within one month.
Who do we share your data with?
We only share your personal data with other organisations when this is necessary or required by law. We never sell your data.
We work with these service providers. They process data only on our instructions and may not use it for themselves. The legal term for this is "processors".
| Service provider | What for | Where the data is stored |
|---|---|---|
| Google (Google Workspace) | Our email and the spreadsheets where form entries arrive | European Union and other countries, including the United States |
| Railway | Hosting of the website and the app, including the database | United States |
| Clerk | Logging in to the app | United States |
| PostHog | Statistics: on the website without cookies, in the app and the Journal only after your consent | European Union (Germany) |
We are required by law to share data with, among others, the police and judicial authorities in an investigation, the Tax Administration and supervisory authorities during inspections.
Data outside the European Economic Area (EEA)
The service providers above are US companies, and the servers of our website and app are in the United States. We are responsible for keeping your data safe there. All four companies take part in the EU-US Data Privacy Framework. For these companies, the European Commission has decided that data is adequately protected there. In addition, our agreements with them include the European Commission's standard contractual clauses.
How do we protect your data?
- Your data is protected with modern technology.
- Only people in our team who need the data for their work have access to it.
- We make regular backups.
- If there is a data breach, we inform you as soon as possible.
We do not make decisions about you that are taken by a computer alone.
What are your rights?
When we use your personal data, you have the right to:
- Access. You can ask which data we have about you.
- Rectification. If the data we have about you is incorrect or incomplete, you can ask us to change or add to it.
- Erasure. You can ask us to delete your data.
- Restriction. You can ask us to temporarily stop using your data.
- Portability. You can ask for your data in a common format.
- Objection. If we use your data on the basis of legitimate interest, you can object. We then stop, unless we have compelling reasons to continue.
- Withdrawing consent. You can withdraw consent you gave earlier at any time. This applies from the moment you withdraw it.
Sometimes we cannot carry out a request because an exception applies. If we refuse your request, we tell you why.
How to use your rights
Send an email to contact@everly.one. We reply to your request within one month. This is free. We do not ask for a copy of your ID as standard. We only ask for more information if we need to check that the request really comes from you.
Do you have a complaint?
If you are not happy with how we handle your personal data, email us at contact@everly.one. If you are still not satisfied after that, you can file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens): https://www.autoriteitpersoonsgegevens.nl/een-tip-of-klacht-indienen-bij-de-ap. You may also do this directly, without emailing us first.
Changes to this privacy statement
We may change this privacy statement, for example when we add new services or when the law changes. You can always find the current version on this page. If you have an account, we let you know about an important change in advance, in the app or by email.
